Declaration on the protection of personal data
SmartWeb gives top priority to the protection of personal data. In the following, we describe which data we collect, when it happens, and how we process your personal data.
When we collect, process and use your personal data, we always comply with all relevant statutory provisions.
When you visit our websites at www.smartweb.dk, www.smart-web.dk, www.smart-web.no, www.smartweb.io, or any of the related sub-domains (collectively referred to as “websites”), you accept that your personal data will be collected, processed and used as described below.
Please note that in principle you can visit our websites without registering. In such case, data about for example browsing history, names of downloaded files, date and time, the domain name of the used service provider, etc. will be stored on the server for statistical purposes, but these data will not be linked to your person. Your personal data, including particularly your name, address, e-mail address and payment data, are only collected if you disclose the data voluntarily to us. We collect personal data in the following situations:
- when you make use of our offers or order services as well as in connection with payment transactions,
- when you open a customer account,
- when you sign up for our newsletter, and/or
- in connection with requests, complaints or feedback.

1. The data controller

2. Security
We have implemented appropriate technical and organisational security measures to secure a satisfactory level of security. Thus, we will do our utmost to safeguard the quality and integrity of your personal data when we are processing your personal data. When you visit our websites, you always communicate with us via an encrypted connection. Use of our websites after you have logged in to the customer area (at https://login.smartweb.dk) is always encrypted. Moreover, we ensure that our websites and other systems are protected against loss and destruction of your data as well as against any third party’s unauthorised access thereto and/or amendment or distribution thereof.
3. Collection, processing and use of personal data
3.1. Personal data
Personal data are any information relating to an identified or identifiable natural person. For example, we collect the following personal data about you: name, address, telephone number, e-mail address and any basic data related to the registration and execution of an order for our products and services.
We collect and use personal data in connection with the functionalities and purposes described below. We can also process your personal data for other purposes if we are entitled or required to do so by law.
3.2. Use for marketing purposes
If, during the registration process, you give us your consent, we will use your data to inform you about products, services and campaigns or recommend products and services that may be of interest to you.
You can at any time withdraw your consent to our use of your personal data for marketing purposes. Your withdrawal may concern general marketing initiatives or specific individual marketing initiatives.

3.3. Newsletter
If, during the registration process or on our websites, you have given us your consent thereto, we will use your e-mail address to send newsletters. You can at any time subscribe to and unsubscribe from the newsletter. All newsletters contain an unsubscribe link.

3.4. Customer account
If you open a customer account, you provide personal data which we will process in connection with the services we offer. Subsequently, your basic data will appear from the entry field of your customer account when you communicate about contractual matters or place orders, and you do not have to enter the data every time. After the free 30-day period, you can register and change your data for payment settlement via the customer account.
3.5 Payment
Our customers can only pay for our offers and services by invoice. Consequently, you cannot make payments by credit card or other means of payment on our websites. Any data collected in connection with a payment transaction will only be used and stored for the purpose of the payment transaction and fulfilment of the agreement made on our products and services.
3.6 Additional data registration
Additional personal data is only registered if you have provided the data voluntarily, for example in connection with a request to customer service when you fill in the “change form” or if you contact us about any other matter. If you have provided us with person-related data, we only use such data to reply to your requests in connection with completion of the agreements on products and services which you have made with us and for technical administrative purposes.
3.7 Consent
When you use our websites, we sometimes collect and process your personal data based on your consent, see above.

If you withdraw your consent, we will stop the processing of your personal data, unless we are entitled or required to continue the processing or storage of your personal data on any other basis, including in accordance with legislation.
Withdrawal of your consent will not affect the legality of the processing which has taken place prior to the withdrawal of your consent.
If you withdraw your consent, you may not be able to make full use of the functionalities we offer on our websites.
4. Disclosure and storage of data
We will never sell your information to a third party. We only share your personal data with third parties under certain circumstances, which are the following:
We can share your personal information with our holding company and other related companies.
In certain situations, we entrust your personal data to be processed by Smartweb's partners and suppliers, e.g. providers of communication platforms, cookie providers, fraud prevention services, providers of customer satisfaction surveys and newsletter services, etc. These partners will only process personal data on behalf of Smartweb and in accordance with Smartweb's instructions.
We may pass on personal data if required to by law, or if a court order or binding decision is received from a relevant authority or court. We will protect your data by always letting authorities and courts document that they have the necessary legal basis to obtain information.
If a supplier or business partner is established in a country outside the EU / EEA (third country), the transfer of data can take place based on several different legal basis for transfers, that establish an arrangement that guarantees the necessary protection of data subjects' rights. In most cases we will use the European Commission's standard contractual provisions on data protection as a basis for transfer.
The transfer of personal data to a country outside the EU / EEA (third country) can take place without further ado if the country is assessed by the EU Commission to have an adequate level of protection.
We delete your personal information when it is no longer needed for the purposes that were the reason for our collection, processing, and storage of it. Even if you cancel your products with us, you must be aware that we still store some data. It is data about your customer relationship that is necessary to be able to determine important actions taken by you or us during the customer relationship. This can be, for example, data that we need to be able to determine any legal claims that may arise from the contractual relationship between you and Smartweb, or data that according to mandatory legal provisions must be stored for a certain period. We regularly review our need for data storage so that we do not store more than is necessary.
5. Your rights
You are entitled to obtain insight into the personal data we are processing about you, subject to certain exceptions provided by law.
In addition, you can object to the collection and further processing of your personal data, and you are also entitled to rectification of your personal data, data portability, or you can ask us to limit the processing of your personal data.
If you ask us to do so, we will delete the personal data we have registered about you without undue delay, unless we can continue the processing on any other basis, for example, if needed to reply to a request from you.

In connection with requests regarding your rights, we ask you to provide us with adequate information so that we can identify you and reply to your request. We will reply to your request as soon as possible and within one month at the latest.
